Answer ‘Before 21 May 2002’ – automatic pathway

Your child is automatically British citizens otherwise than by descent if you or your child’s other parent

  • are a British citizen, or
  • have Indefinite Leave to Remain for your British Overseas Territory home, or
  • in the UK Armed Forces

The Home Office has discretion with applications to register your child as a British citizen, if none of these 3 things applies to your family:

You or your child’s other parent

  • are a British citizen, or
  • have Indefinite Leave to Remain for your British Overseas Territory home, or
  • in the UK Armed Forces
