Benefits that are public funds

You cannot claim most benefits when you

  • are subject to immigration control OR
  • do not pass the habitual residence test OR
  • do not pass the right to reside test

This is because you are not entitled to claim benefits that are classed as ‘public funds’. Most benefits are classed as public funds.

Contribution-based benefits

You might be able to claim ‘contribution-based benefits’. Benefit rules say your record of work and paying national insurance in the UK  should decide if you are entitled to them.  If you have worked legally in the UK in past years and have got a record of paying national insurance check the list below.
